Re apllying for my Job? legal or not?

Hi gang, not sure if i am in the correct place, but my question is this..................

3 year ago i was told we had to re-apply for our own jobs and that the roll was no longer there, so we all done so, this was a few week process. finaly we was made to do a test! 3 of us engineers was told we got below the par on the test, the next day I was contacted and told i have a position at 20k Per year, this is a come down from my basic of 28k (a drop of 8K, almost a 3rd). next day i came in and continued to work at the same desk doing the same job up until present day. Only the 3 people that done bad on this so called test was docked money. I am spireling itto dept as loans and cards i had taken out was against my old wage. I have never taken this further before due to them being difficult at work or my card being marked. I dont feel this correct at all and it leaves a bitter taste in my mouth at the thought i was on more money in the same company 12 years ago at the age of 23 then i am now, no pay rise and no possibility of moving up. IS THIS LEGAL? and what can i do. I calculate i am owed 23k from the date of this change in wage and thats without interest.

Cheers For any help,

As far as I know employers can reduce your wage. It has happened a lot in this recession.

In this case it seems that the empkoyer has found some reason to question the OP's competance in the old position and has effectively demoted him. Seems a very drastic step to take.

However, you have a job and presumably you will get a good reference, so maybe applying for a new job would be your best option making a fresh start with a new employer.

However, either way it seems like a job for a good employment legal expert.

So why are you only raising it now?

Yes. By working on and not objecting to the change, you have affirmed the change to your contract. It is now far too late to challenge the events of three years ago.

    and what can i do.

    Nothing

I calculate i am owed 23k from the date of this change in wage and thats without interest.

    Cheers For any help,

  • I am sure those with better employment law will come along and give advice before too long but I echo the comments of others that 3 years is a long time to sit and stew.

Why haven't you done something about it earlier? If you felt you were good at your job and worth £28k not go out and get another job elsewhere for that money? I know the recession and everything but what would be an almost 50% payrise would seem worth the risk.

You can get another job. That's it.

As others have said, three years is too long - if you could have done anything about it you had three months to make a tribunal claim, not three years.
