Urgent advice needed re application to vary a CCJ

I'm not really sure which part of the forum to post this request but I hope that putting it here will achieve some response.

One of my creditors has had a County Court Judgment awarded against me in default, i.e. I did not defend the claim (don't ask!). They are now pursuing a charging order against my property. I dispute the amount owed and despite several requests (even by the judge in the charging order case - now adjourned) to provide details of the amount owed - none of the amounts provided add up to the amount being claimed. Neither I, the claimant's solicitor, nor the judge could determine where the amount being claimed came from. As a result, the judge has agreed to allow me to make an application to vary the judgment, i.e. to dispute the amount owed, plus claim the collection charges applied to the account.

It is my understanding (I may be wrong), that I need to complete a form and submit this to the court. Can anyone tell me if this is correct and, if so, what form I need, or what I need to do if it is not correct, or how I can find out what I need to do? The judge was not very helpful in this regard even though I had already demonstrated my lack of knowledge (see comment re no defence!).

  • You need form N245 - which can be found on the court service website... they may be a charge of £35, unless you are on qualifying benefits.. If you are then you also need form EX160...

    Thank you, plumduff-2. I contacted the Enforcement section of the Court yesterday and someone there said that I needed Form N244 - having said that, he didn't seem to fully understand what I was trying to make an application for. So, I'm still not sure - maybe I should fill in both forms, take them to the court and see which one they want?
