yeah i did sign the agreement, im not even sure if it has payment protection on - i just know there were 3 people in a room hassleing me to sign the agreement, they knew I was stuck at the time, the loan is not in arrears- as im paying the solicitor direct now,but its the charge on my property as well, i want to contest that and also the amount im having to payback- but when i phone hsbc its a call centre in india who fob me off,at the moment im paying a debt with no agreement in place - im going around in circles

It really is amazing how casually people seem to treat borrowing money. They borrow £10,000 and don't even know whether they have PPI, they don't keep the document of the agreement, they don't read the T&C's. They often conveniently forget that they have borrowed any money at all. They try to wriggle out of the agreement and seem amazed that the lenders are trying to get their money back.
I am not referring specifically to the OP while making these comments, but to many OP's on this forum. You have only to read many of the posts to know that what I am saying is true. The old adage that all actions have consequences is so true.

Have you obtained a copy of your credit agreement in the 4 months since you last posted on this thread?

There really is no point trying to phone the bank at all to discuss a debt once you are in this position. You need to do everything by letter (whether thats doing the CCA request, requesting a statement of all transactions, doing a subject access request, making a complaint etc etc). If you are going round in circles its because you are not dealing with it in the right way.

And ALL our HSBC Loans in last ten plus yrs have had interest front loaded so would assume it's something they always do. I have copies of our various loans with them ( kept consolidating ) and all state the interest so yes you're best making the formal request for a copy of your agreement

    this is simply not so

they are not allowed to front load interest although they are obliged to show the total cost if it runs to term (this may have confused you)
