    You have a very very slim chance of winning an endowment claim via the courts. You can almost count the number of successes on one hand. Often the successes are due to technicalities.

    Remember you have to prove that it was mis-sold. What evidence do you have to show it was mis-sold?

    Also, what are you claiming for? At this point you are not out of pocket. Indeed, you could be financially better off as endowment mortgages were usually cheaper than repayment. A shortfall doesnt exist until you get to maturity. In the meantime the value fluctuates and after a crash it could be off target a little or even on target but still showing a shortfall on the projections.

    My complaint is with the claims company I signed up with to get my endowment compensation not the endowment company. Oasis financial Services misled me throughout the process about the 'so called work' they were carrying out on my behalf. I did win compensation but the fees they are trying to charge me are ridiculous. Intend bringing Oasis to court to reclaim these fees.

    Many of complaints companies mislead on the work they do. Just ask any complaints handler at an insurance company or IFA network and they will tell you that the same template letter is used by many firms. All they do is insert your name and address and a few mergefields. About 2 minutes on microsoft word and job done.

    However, that isnt grounds for you to go to court over. You used this company to handle your complaint. You won your case, and got redress. The company is entitled to be paid the amount you agreed before you employed them.

    Complaints companies tend to have their contracts watertight.

    Their marketing material was misleading about what they do and they've actually removed the claims they were making as a result.
  • If they have removed the claims and you have subsequently won then you should be able to dispute the bill. I have not seen the terms of business but give it a read to see if it is inherently unfair in their favour, judges tend to take a dim view of unfair contracts, even if you signed it.
