Urgent help pls - Bailiffs due on Monday

I'm posting on behalf of one of my best friends, as she is way to distraught at the moment.

Long story short.

A small business debt (from a number of years ago now) which my BF tried to settle amicably has reared it's ugly head again in a very unexpected and potentially incredibly damaging way.

The 1st debt collection agent (on behalf of the company in question) openly stated that her 'client' wasn't really interested in payment, they were after revenge. Nice.

After well over a year of complete silence on the matter, my BF received a visit from a Bailif today, who has gone around her house making a list of all the property he's going to come and take away on Monday... including her computer and car. It's possible that if she can prove in time that her computer is essential for trade, she can protect that; but not her car according to the bailiff (which is also essential to her business).

While he was going around her flat with his warrent thingy, she opened her mail and found a court letter saying they had found in favour of the vengeful company. This is the 1st court communication she has ever received, so had no idea there was a court case, let alone been able to turn up to defend herself.

There is an appeals proceedure, which will be explored, but that's too slow a process to stop the bailif action in it's tracks.... and that's what she need to do before anything else.

If anyone has any expert advice (through experience or professional knowhow) on how this bailif action could be suspended / tempered by Monday, I'd be deeply grateful for your input.

I'll be hovering around this post semi-permanently awaiting responces.

    go over to the bailiff section of the .consumeractiongroup there are a few experts over there who will help with this
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

    If she is as absent minded as you say over her mail, opening it when it suits then there is probably a lot she is hiding from you.
    The fact that she let the Bailiff in has taken things beyond help you can offer.

    if you really want to help, go around, help her open the rest of the mail, check that these are actually court letters not debt collecting letters and if so tell her to get the debt paid in full at the court.

    Thank you for your input. However I have not expressed or implied that she is absent-minded. The court letter in question arrived today, 3 minutes before the bailif did. Taking 5 mins to open mail isn't absent-minded or 'delinquent' behaviour.

    As stated, this is the only correspondence/communication she has received from anyone on this matter for well over a year, and the very first piece of correspondence she has received from a court regarding a case on this matter.

    perhaps you are acidentally likening her to someone you know, who IS very good at doing an impression of an ostrich, and reading my post through that perspective?

    The only way that could have happened is if she has changed address and not told the creditor where she has moved to, the creditor has applied in the last know address for a ccj and it is the bailiffs who have traced her.

    In which case she may be able to overturn the CCJ?
