Overpaid wages???

    Employers are legally entitled to recover overpaid wages unless certain conditions prevail including the employee being entitled to believe the wages were correct.

    Your situation is complicated by the fact that you no longer work there so they would have to pursue you via the county court system if you refused to pay and you probably want to avoid this.

    As OPs have said what action will be taken will depend on the employer. You certainly need to ask for documentation showing the overpayment less tax, NI etc. I would suggest a first response would be to say that the money disappeared as soon as it hit your bank as you have an overdraft. If they still ask for the money then offer to pay in instalments. If they refused this would your reasonable offer a judge is less likely to look on them favourably.

    Morally as well as legally you should pay it back but as they made a mistake then treating it as an interest free loan seems reasonable!
