Health problem being ignored by NHS - court action?

I've been suffering for years with a health complaint causing severe pain which is frequently quite crippling.

The Doc sent me to see a specialist 5 years ago who basically decided there was nothing he would do for me and told my Dr this in writing. My Dr then advised me in person to live with it.

4.5 years later it's still driving me nuts. I got to see the Dr again who agrees reluctantly to send me for another referral to another hospital. This time they agree that they can perform micro surgery on me using one of those stent surgery techniques to block and kill a vein which was causing the problems.

4-5 months later, the op happens! Woohoo! I could barely walk for 2 weeks and was still uncomfortable for a month while the vein 'died' but it eased off and took another long term health complaint with it.

Ii saw the doc and mentioned the other complain going away who basically admitted "Yes the two are related, we never thought of that being the cause of it". I have an audio recording of this in case he tries to deny it.

Unfortunately during the surgery, they didn't put in a coil to block / kill the vein... they put in FOUR :eek:. Now the pain has been a lot better but it started coming back months ago and I was sent for another scan. The scan came back all clear but the bloke never scanned the other symptomatic area (why is is such an issue to move the ultra sound scanner 2-3 inches further?). My doctor hasn't done diddly squat again since.

I made a freedom of information request to the NHS about the procedure they performed on me and it turns out the procedure has been available since 1981 :( :mad: So in essence they knew what was wrong, knew there was a simple treatment and made a choice to legally inflict 4.5 years of pain and suffering on me.

Now the pain is getting worse again, I suspect the operation hasn't been 100% successful and since the last scan they've not been interested. Can I get a court order to force my local NHS to deal with this issue once and for all? Where would I start? I just want it all to stop hurting but the NHS have already proven they'd rather I live in pain.

What can I do?

    It might be cheaper to consider private medicine to at least diagnose the problem. More beneficial than spending the same amount of money on solicitor's fees and then having to spend on the private medicine as well.

    If a private consultation gave information that contradicted the NHS, well, that might spur the GP/hospital to do more/get you seen somewhere else, and then you could consider legal redress.


    But solicitors are expensive when all you really want is to be better.

    Couldn't you ask to be referred to a different hospital.
