SSP - can you tell me if i'm entitled?

My oh's company is no longer paying sick pay, as of beginning of Janurary, he was off on wednesday, thursday, friday, a couple of weeks ago and so wasn't paid, but i was wondering if he would be entitled to SSP?

    You do not get SSP for the first three days of an illness.

    Who can get Statutory Sick Pay

    You may be able to get Statutory Sick Pay (SSP), if you have:
    • been sick for at least four or more days in a row (including weekends, bank holidays and days that you do not normally work)
    • average weekly earnings equal to or more than the Lower Earnings Limit (LEL)
    does this make any difference as to whether he should get it or not, as if he includes the weekend, he was actually of sick for 5 days?

    that only counts if they do not go back to work on Monday

    Why is the company no longer paying sick pay? Have they gone over their limit?

    You only get SSP for the days you normally work, it's just that in adding up the 4+ days it's not just working days, it's everything continuously. If he works Mon-Fri and was off the Weds-Fri then he won't get anything. If he'd been sick the Monday after as well he would have received one day SSP.

    Yes, 'apparently' he has gone over the limit, we didn't realise this until we were over £200 short this month..
    can't believe if he'd had the monday off too we'd have got SSP for that week... oh well, not much we can do now..
    just so annoying when you think your doing the right thing by going back when your better, but in actual fact we could have got £80 back, but now we're over £200 down, grrr..

    You wouldnt have got £80, where do you get that idea from. Sick pay is about 15£ a day.
    If he was well enough on the monday to go to work then he was well enough, if he hadnt gone in he would have got approx £15. You dont get money for the whole week

    edited because on second thoughts i felt my original post was a bit unfair, and I mentioned Jesus......
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    Just to be sure ..... if your oh had called in sick on the Monday, they would have been entitled to one day SSP only (the 3 waiting days are not payable).

    I assume that they are paid more than £15 a day, so they were financially better off going into work.

    As has been said there are three waiting days before SSP is paid and to qualify you need at least four days of sickness. Assuming that your OH was sick on the Saturday and Sunday then there were five days of sickness so a PIW would be formed and the employer would need to record this for SSP purposes. If the qualifying days are the same as the days worked then Wed - Fri would be waiting days and Sat Sun non-qualifying days for which no payment is made. This appears to be the case as qualifying days are usually the days normally worked but they may not be, so could be worth checking what the qualifying days are.

    Also once a PIW is formed it will link with any other PIW that fall within eight weeks or less either before or after this PIW. If the PIWs are linked then only one set of waiting days has to be served within the linked PIWs. So if there was a PIW withing eight weeks before this sickness the waiting days or some of them may have allready been served, or if there was another sickness that formed a PIW within the eight weeks after the current PIW ends then next time the SSP would start from the first qualifying day with no waiting days.

    This is why all employers should ask what was the first day you were sick and did no work and the last day you were sick and did no work, not just when were you not working, as these non-working but sick days can affect linking and so affect waiting days.
