£600 sent to account in OD by mistake, can we get it back.

Dear Forum;

This morning I have done a lot of swearing!

Due to redundancy and a failed company I am unable to meet monthly repayments on my debt, to such an extent that all my creditors have accepted a £1 token payment per month.

My old current account is now over its OD limit.

A week ago my partner sent me £600 towards the rent I pay, but sent it to my old account, which is (or was) over its OD limit. This was an error.

I discovered this morning the error, so the money is in the current account which I am making £1 payments too, and now I expect unable to get the money from. This means I can not pay my rent this month.

This is an odd situation, but has any one experience of this before, will the bank look kindly on this, understanding it was an error and that I can not pay rent without that cash. They have been understanding so far with my financial situation,

    I know it is not what you want to hear, but i dont like your chances much. Turn the situation round if you were owed the money? would you want to give it back?

    The only advise i can give is try and claim that your partner sent it to the wrong person, i.e they never meant to pay to you, and they want to get the money back.

    Sorry, but i dont think you have any chance.

    Look at it from a different angle, if someone owed you £600 for a long time and it suddenly appeared in your bank account.

    Then they said it was a mistake, can I have it back and still owe you the £600 and I'll pay you £1 a month instead.

    Now be honest.................
    make the most of it, we are only here for the weekend.
    and we will never, ever return.
  • Just a thought but can your partner tell his bank that it was an error? they might be able to get the money back (esp if you've told your bank that the money shouldn't have gone in)

  • Very unlikely but all you can do is ask (and get your partner to ask their bank).

    I hear you, why would they give the money back, reasons would be (possibly)

    They have already acknowledged the issues I am facing and how tight things are, and that I need to pay rent
    The money was not sent by me
    The money was sent in error

    It does leave me 450 under my OD, so my quandry is whether to try and talk to them and have it returned in full to my partners account, or just to transfer the 450 before bringing it up with them.

  • We 'lost' £166 to our old OD account last month. The sender couldn't get it back and the bank wouldn't hand it over. We've just had to take the hit and think of it as a lessening of the total OD debt instead.

    The only thing to do, I reckon, would be for your partner to get in touch with the bank - asap - as say that in an error they've sent it to the wrong account, it wasn't meant for you, could they have it back in order to reissue. Then you hope for the best.

    As other posters have said the bank will not give it back.

    The sooner you relise that the bank is there for profit not your well being then the sooner you are in a better place.

    Its there money now and its not really there concern as too what you needed it for.

    Debts/credit is there to be managed, Not used and abused.

    And as for tranfering the 450. If the bank is smart (unlikely) and you have bad credit record, i would have thought the would lower your overdraft.(so if you can get it out now, if its that important)
