Redundancy and resuming work

Sorry this is long winded! I am a manager and carry out accounting and Payroll for a small company. I was told in early September 2011 that the company was seperating with 2/3 being sold off to existing employees and that I would only be needed 1 day per week instead of 3. Originally this was to have happened at the end of November. By mid November they told me it would be the end of December and then the end of January. (Nearly there!) Last week, the boss decided that I could retrain for another job and the training would take 1/2 day per week. The 'new' job is to cover sick leave/holidays for other members of staff. Today the boss decided to mention my redundancy pay. I have worked 10 full years so I calculated that I am due 15 x weekly salary. First she said it would be 10 x weekly pay, then said that I am only entitled to half that amount because there has been no break in my employment and she is guaranteeing me one days work per week, possibly one and a half days. Any thoughts on whether I am entitled to the full redundancy and can continue to do my normal work, albeit only one day per week instead of 3?

You would do best to contact the Arbitration Conciliation and Advisory Service (ACAS) for up to date information on the points you raise in your post. I've used them and they are very helpful. Good luck.0

The first thing to consider is should you be staying with the 1/3 or the 2/3rds.
staying with the 2/3 might come uner TUPE so you transfer to th new entity then they have to deal with any potential redundancy.
If you stay working then you are not redundant even if it is just 1 day a week so there should be no payout.
If you leave, then the full redundancy kicks in.
With 10 years service
You have 10 weeks notice minimum.
statutory redundancy is 10 weeks pay capped at £400* + 1/2 week for every year over 41(count backwards from leaving date.
Have you been given the correct notice of termination?
*£400 increases on feb 1st, if you have not been given the correct notice you may qualify for the £430.
If you take the redundacy then you should not be continuing to work as an employee.
There are a few options, but get the basics sorted first.0
