    Hi,
Thanks for your response, on an email they sent they said that they do calculate interest at a daily rate and it is £9 per week per £100. I did not contact them straight away because I thought by just returning the money straight away would solve that matter. Any advice on what to do? Im a student and mother of two toddlers, I took what I could afford to pay back, I knew I couldnt afford £400 so I didnt even hesitate to return it.

Unfortunately for you, you have taken a loan from the most underhand payday lender available. You have probably already found out that they will not communicate with you in any other way bar telephone. Please go back to your original loan agreement and check on that how much you agreed to borrow. If it is £400, then I am afraid you agreed to it and they will chase you for it regardless of the fact you returned £200 of it. They do not waive fees for early payment like Wonga does.

My advice is, if you can afford to pay them and close the account then do so and put it down to experience.

Otherwise put on your seatbelt and expect a bumpy ride. They will threaten you with doorstep visits, they will add unreasonable charges to your accout, they will be agressive in any communication, they will call you and text you multiple times a day on any telephone numbers you have provided, they will dip into the bank acount details you have provided at will until they get the money you owe plus extra charges. They will pass on your file to the desk opposite them and call it a different company name and charge you £300 transfer fees. They will continue to charge you interest at the original agreement rate once passed onto a debt collector northern debt recovery/marshall hoares bayliffs (who's consumer credit license holder is the same as toothfairy) even though doing this violates the OFT's guidelines on debt collection.

This company is a disgrace. Good luck.
  • Hi Michael,
Thanks for replying... By the sounds of it I do not stand a chance then do it? The loan agreement does infact say £400, but I didnt ask for it and im so angry at the fact that i may have to pay them to avoid hassle. I really do not have the money, My idiotic partner has just lost his job, Im being forced to carry all our finances on money i get every three months, plus paying rent and council tax. I have other household bills that are in arrears, so I cannot even think of finding £86 to pay them in 2 days. Is it actual legal for them to add £350 as they said to my loan for sending to a debt collector!! I mean are they for real?? There must be something I can do to get them off my back, and why can i not speak to them on the phone?

I feel for you I really do, in terms of legality of passing on your debt they can add it to your file however if you were to be taken to court then the judge would likely dismiss that payment should they even have the balls to add it onto the case. In fact this company does not take people to court and the likely reason is that they would have to explain their behaviour and demands to a court of law. I am not sure what else I can say to help you but if you can find that £86 then my advice would be pay it and chalk it down to experience and never use them again.
  • Many thanks for your help. I will try and see if I can possibly find any payment towards. Im gutted to be honest, I may have well had kept the £400 for all this trouble Im going to get into if i dont stump up the cash. May I ask what happens if I refuse to pay and they do add their extortionate fees on? I know I will get hunted, but they do not have my correct address as i moved, I havent even told my bank yet. The account they have no money goes into there. The number I registered with them is no longer in use. They will only be able to contact mem via email so if worst comes to past, and I refuse to pay the debt collectors, How will it affect my credit profile? I wish to be able to mortgage a house when I finish uni and get a job so I want something on my credit for 6 years.

    Thanks in advance

They will call your employer, if you have one and on a daily basis. If they know which university you go to they will call there as well. If you register on the electoral register an adress they will also harass you there. They will destroy your credit file as well if you move house and not inform them as is their right to do.

They're wanting the money so you cant blame them for that, why not agree a payment plan with them in writing. Its gone up to £748 as i bet some of it is interest or maybe missed payments.

Just to clear something up. For loans creditors cannot instruct bailiffs without a valid warrant of execution from the court, and you must have first defaulted on a CCJ for the to have been able to apply for one.
If they have not taken you to court, they cannot instruct bailiffs to enforce the debt. However, some bailiff companies also have a department that work on debt collection the same as other debt collection agencies. Anyone that does attend your property will be a debt collector and has no powers to force payment or seize goods. If any bailiff DOES show up at your property stating they have a court order and are demanding seizure of goods but you have had no notifcation of any court action then you should NOT let them in, keep doors/windows locked, and any vehicles away from the property before seeking legal/debt advice.
