Debts of previous spous - please advice

Hi All,

My partner is currently going through a devorce from her previous husband. Since devorce proceedings started, he has disappeared from the face of the planet and no one can find him.

Since the debt collection people cannot find him either, they are now coming after her for in excess of £400,000 pounds. She was unaware of these debts, until the solicitor found claims for them.

Since she was unaware of these debts, and did not sign any agreements for these debts, is she still liable just because she was married to this nasty git?

    Are the debts in joint names or just in his name?

    If in joint names did he forge her signature?

    If they are just in his name then she is not liable to pay them.

    Do they have a house they both jointly own? if so are any of the debts secured on the house or do any of the creditors have charging orders (or restrictions) placed on the house?

    Where would liability lay if someone else has signed for her?

    They did not own a house, they rented.
  • i knew someone who was in similar position.. took ages to prove ex forged signature on loans etc..

    post his pic on facebook, twitter etc, with contact details of debt agencies!

    Has he really run up £400k of unsecured debts? wow thats 'impressive' that he could get even a quarter of that amount of credit. Are they all regular consumer credit from banks etc?

    The debts just in his name, nothing at all to do with her - simply return any letters addressed to him in relation to them as 'not at this address' or similar on the envelope.

    If he forged her signature on agreements then she will need to inform those creditors that she believe that is what has happened and that she has no knowledge of the debts. She'll need to get copies of the credit agreements and to report her ex to the police for fraud. The creditors should then investigate and hopefully she'll be able to prove/convince them that she had no knowledge of the debts or agreements - buts its likely to be a hard slog overall (and in the meantime her credit rating will be trashed until she can get it sorted).

  • She had a good income and a big saving account, all her money is frozen due to the divorce.

    The claims are currently with her solicitors.

    The Police have been trying to find him for the past 12 months, but have yet been unsuccessful.

    why doesn't she have a good income any more?

    anything stopping her filing for bankruptcy?
