Paying late fathers debts from Pension Payout?
Sideways
My wife was recently contacted by a Pension Company regarding her late fathers Occupational Pension which matured recently. He died five years ago and my wife is his next of kin.
The Pension Company have confirmed in writing the policy has a death value of roughly £13k which is being held in a holding account. They have requested a letter of Probate before releasing the money to my wife.
My wife has visited a solicitor to make the necessary arrangements. The Solicitor asked my wife if her father had any outstanding debts, she said she dint know of any but would be surprised if there wasn’t (he died an alcoholic with mental health problems). The solicitor said she would look into it.
If it is discovered there are outstanding debts, must they be paid for from this Pension payout or are Pensions protected in any way? Also, are there any hidden dangers my wife should be aware of, will she be held responsible for the outstanding debts once she officially gets involved?
Any advice is very much appreciated.

The pension is a trust arrangement. So, any proceeds paid out are outside of the estate and do not need to be used to clear debts. Also, are there any hidden dangers my wife should be aware of, will she be held responsible for the outstanding debts once she officially gets involved?
If assets of the estate were distributed by the executor without any debts repaid then there could be. The beneficiaries would have to repay the debts and the executor could get into trouble. Who was the executor of the estate? (i.e. a family member who didnt know what they are doing, someone that does or a solicitor)I am an Independent Financial Adviser (IFA). Thanks,
As far as Im aware nobody acted as an executor after his death, he did not own any assets and died alone in a hosital. Its a sad story.

Sounds like any debt dies with him if the estate had no money/assets.0
