I was supposed to bet paid on 8th January for december work 1- 31st. My Employer said on 6th that they didnt have enough money to pay .. we eventually got paid on the 16th !!
We have now been told that the next pay has now changed from the 8th to the 20th, so we should be getting paid on the 8th for Jan work but now it will be the 20th (still for jan work ) What rights do i have

You are then getting paid for Jan on Feb the 20th so almost two mths with no pay.
Did they give this to you in writing?0 -

Not quite sure where you got two months without pay from. My understanding from the OP is that they got paid on 16th January and have now been advised they'll get paid on 20th February.
To the OP - I'm sure that you are entitled to claim costs incurred for being paid late; however, you must take reasonable steps to minimise the costs.0 -
You should be paid on contactual terms but if they have no money there will not be a lot you can do.
I would be having a good look at the business and the viability of it continuing.0 -
As stated, having rights and being able to enforce them are two different issues! If they haven't got the money, no amount of pressure over rights will make it materialise so it can be paid to you.
Far better to engage in sensible dialogue to try to inform yourself as to whether this is a temporary issue (e.g. major customer hasn't paid a bill so need time to build cash reserves back up) or the beginning of the end (probably more likely) so that you can start to look for another job and/or plan for what you might need to put in place if you lose this one.Adventure before Dementia!0 -
they were meant to get paid on the 8th Jan for December and now Jan will be paid on the 20th Feb so by my calculation thats just over 7 weeks from the end of the last pay period if the Dec one went up to 31st DecNot quite sure where you got two months without pay from. So you now agree 2 month was wrong?
The point is there is very little they can do about it.
OP needs to monitor the situation carefully and look for the signs it is going to get worse.
