i know, but i need this sorting as its affecting my ability to acquire any credit anywhere

Surely a Default Notice should have been served giving time to rectify the situation??

thats exactly what i thought too, and i would of thought they had to show that they had taken the right steps to recover the debt, even though it was only £10.21

A mobile contract isn't covered by the Consumer Credit Act, so no written default notice under that is required.

The ICO strongly recommends that a "notice of intention to record a default" is issued, which is not the same thing.

It looks like it isn't a requirement they have to adhere to, just a recommendation.

Unless they agree to remove it then yes, pretty much.

If they won't, then the best thing you can do is pay it, so that it shows as settled on your record.
