Hello

I have reached rock bottom and fell only way forward for me is bankruptcy. I have debts of 38K. I used to be able to pay them each month then change in circumstances and personal stress kicked in. I went ON DMP and kept up for a year, more problems led to my not keeping up payment and they would no longer keep me on the plan. I have tried to make a small payment to 3 creditors as they were so agressive. I now am no longer working and am on J.seekers allowance. with help rent and c.tax.


Q. Do I fill in the forms first and present it to court.
Q. What paperwork will I need to gather
Q. Do I have to have everything ready- paperwork before petition or do I have to wait until its requested.
Q. Have second hand car value 1,700


Did contact National debt line does not look like I have options. Is it best to get professional help filling in forms or do it yourself.

    Yes. You need to talk to your court to make an appointment.

    None really for the court, but afterwards the OR may ask for credit agreements/statements going back a few years. Not a big deal if you don't have some, as the OR can get them from creditors themselves. Just easier for them if you have them.

    The forms yes. The rest, just see what they ask for.

    Q. Have second hand car value 1,700 need this as have to support ill daughter and mentally ill brother- hospital etc. Will they take that

    You would need to make a case for keeping it. They may ask you to get a cheaper one, as now even when exempted £1,000 value is usually the max allowed. That is only a guideline though. If your circumstances are exceptional, or the excess value above £1,000 is not worth the cost of recovery and selling, then exceptions can be made.

    Am ashamed of the gambling part but when on those sites you loose reality. Have closed it down.

    Good. You will likely be asked about where that money went however. If they think you have been reckless, then it might result in a BRO/U.

    No need to pay for help. Professional help can be had for free, or people on this forum can help. We've done that for 100's of people now.

    I stupidly used online gambling site to blank it all out and of course lost a lot of money including large chunk of redundancy money. So stressed with it all BR seems only way out as at nearly 58 years no hope of paying it all off.

    Q. Do I fill in the forms first and present it to court.yes as long as you have sort advice from CCCS or CAD or another body then you can go ahead

What paperwork will I need to gather,all you need to do is ring your court who will either send you them or tell you how to print them off their web site(better to get them sent out as there are 3 copies needed and they are quite long so loads of ink and paper needed)apart from those no other paper work is neeed untill after your BR then your OR may ask for statement etc but mostly they can get this info easier than you so dont bother asking you for it,the forms you fill in ask for dates of loans and balances owed etc I just put a best guess down.

Is it best to get professional help filling in forms or do it yourself.I did the forms myself and I'm not that smart,just do a little each day,most of the info the OR will be checking anyway so a best guess was all I did on most of it.dont worry if you forget a debt as well as all are covered even if they are on the form or not.

    Sorry to bang on just head is puddled and full of all this every day.

    Thank so much for the replies I received very helpful and I will take the advice given and get forms. I think taking some action will be better than none and its time to make a new start.

    Fermi provided me with a link a couple of days ago to be able to pay for it on line and view for the 2 pound charge or get it received in the post.

    The only reason, I put recorded delivery on my posts is that we have had many posters who have had to send to the credit agencies several times and faff about getting more P.O's as they had not received their files. I have a feeling they'd rather we spent more than £2!!
