Setting off rules

Hi everyone

I've been lurking on these threads for months now, adn I have finally taken the bull by the horns and start dealing with matters. I have opened a basic bank account with RBS but I am concerned as I have a debt to Goldfish Credit Card from years ago. I think Goldfish were sold to Morgan Stanley who in turn were sold to Santander - the info that came with my RBS account says RBS is being sold to Santander in 2012. The debt on the Goldfish card has been sold to several DCAs and is now owened by AKTIV CAPITAL - my query is can Activ Capital help themselves to my salary in my RBS account under the setting off rules?

    I can't see that they could because it's now aktiv capital that owns the debt, not goldfish or RBS or Santander. I take it you've had notice of assignment of the debt to aktiv capital?

    Hi all,

    A quick question, I had a credit card with Halifax which Im disputing the alleged debt, what I want to know is that can they take any money from my Sainsburys Bank savings account? I know some banks using the setting off rules to take money from accounts, but as Halifax owns 50% of Sainsburys Bank would they have the powers to do this?

    According to this table http://www.payplan.com/debt-news/2011/01/20/right-to-offset/ yes there is a risk of offsetting. Can you move your savings elsewhere?

    Thanks for the reply, looks like I will have to move my money elsewhere... perhaps give it to my wife (lets hope she wont go on a shopping spree!) :-)

    Why not open a co-op basic account and get your money paid into there?
