Missing hours to be paid after P45 issued

I left a job on 26th November 2011. Got my final payslip on 22nd December and there were hours missing. After lots of chasing it will be paid on 31st January. However as they have issued a P45 it will be taxed at 20%.

a) Do I have any recourse for late payment and fact that this has resulted in tax being deducted? Guessing no as was fortunate to be able to dip into savings so only cost was letters and phonecalls.

b) How do I get my tax back? My earnings for this tax year have still to hit my personal allowance.

    A) You have no recourse, it happens a lot and the employer has to tax you on it they have no choice.

    B) Ring the tax office and explain what has happened after you have been paid. They will inform the tax office what they have done and they will have a record of it.

    In theory if it is the employer's mistake you could claim whatever you have lost in interest on the money. However, it is unlikely to be enough to be worthwhile.

    If these were extra hours (assuming you earn enough to have paid 20% tax on some of your wages) you would have paid 20% tax on the money anyway. If you have paid too much tax you can reclaim it from HMRC.

    Thanks wouldn't have paid tax on them.

    According to my ex-colleagues their hours rarely tally and some of them hadn't realised! They trusted their employer to get it right!

    As advised the employer is following the correct procedure for this payment. The tax office will not know about this though untill after the end of the tax year as the employer does not have to advise them what has happened, just include these figures in the return made after the tax year ends.

    From the employer guide
    "You do not need to notify us at the time of making
    the extra payment, although you must ensure that it
    is recorded on form P14 at the end of the tax year"

    It may not be worth the effort but he could reasonably look the the former employer to compensate him. I would be tempted to send a polite but firm email setting this out and ask to be reimbursed.

    May do that but given it took 1 letter, 1 visit and 3 phonecalls just to get what is owed think may just file under sh*t happens.

    Will take comfort from fact that have taught all my ex-colleagues to check their payslip and that during my visit payroll commented that they were getting lots of queries from my department!
