Been chased again by WMD

Why do Sygma Bank / Creation Finance just not get the picture, the day of my Bankruptcy I emailed them a copy of my bankruptcy order, then they passed the debt onto Clarity who I informed I was Bankrupt, they then passed it to Moroncroft at this point I sent a complaint letter to Mornoncroft and then to Creation, this was last August, I got a nice speedy reply from Mornoncroft apologising saying they have closed all my files and sent back to Sygma / creation Finance with a copy of my complaint and concerns. Well i have never heard anything back from Sygma Bank / Creation. Then in December another letter from WMD, West Midlands Debt Collections Ltd, but I think they are actually Sygma Bank, it has an address of Admail 4117, Manchester M4 2ZZ, the letter does not state any company number or registration number, but looks exactly like letters Sygma sent / Creation finance sent and in fact the payment slip on it says Sygma Bank Head office account and on the back it directs me to the creation website to pay. How can i get these !!! holes to stop hounding me, this will be the third debt collection company they have used, i wish they would try to take me to court I would love it, just to make me feel better I drafted this response

Client Name: Sygma Bank UK

Thank you for your recent letter(s) reminding me that I have not responded to your earlier letter(s) regarding this outstanding debt. Firstly I would like to thank you for your concern relating to the seriousness of the situation, it’s not often these days that people show such concern for anyone, I’m sure this must be a direct result of David Cameron’s big society plan, which reminds me I should check on Mrs Smith next door, just so she knows that she also has someone who is here for her should she have any concerns.

I take note from your letter(s) that you have every intention of collecting this debt, even if you have to arrange for collector to call at my address, or commence legal action, well you must do what you feel is right in this aspect. However I am concerned that you have not understood my position on repaying this debt, I propose that I shall offer to pay nothing, nil, zilch, zero, on all three of the above accounts as this is no longer my responsibility, if you actually check with your client Sygma Bank UK they should enlighten you to why.

I am sure this is causing you considerable worry and no doubt you have probably just pooped your pants thinking that I’m not going to pay any money, but don’t worry, for me to be able to help you help me you can always write to me at the above address as I don’t have the desire to speak to you on the phone, I’m always happy to reply to a letter however if you do get that urge and you can’t help yourself you could try the adult chat number on 0982 932 0090

Yours sincerely.

Calls to 0982 numbers are charged at £1.53 a minute from BT landlines. Cost of calls from other providers and mobile phones will vary. Please check with your phone providers.

I wish I could sue there asses, they are making my mental health worse, they know im bankrupt and im pig sick and the OR seems to do not much as ive let me know as well, my case is with RUTL now and I wasnt even told, just shows that on the website now.

Thanks

Matt

I like the letter, but seriously I'm sorry about this situation, especially if its affecting your health.

A poster on here (can't remember who) often posts a letter you can send to them - that might be helpful. Hopefully that poster will see this and then post the letter.

    Good luck.

NOTICE: Pursuit of a debt included in a bankruptcy. Do not ignore this letter. You must cease collection activity IMMEDIATELY.

    Dear Sir/Madam

    Account No: 4563210025897412

You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.

I would point out that the account was included in my bankruptcy which commenced on <date>.

Consequently, the debt in question is no longer my legal responsibility.

ALL contacts and claims regarding the debt MUST be addressed to the Official Receiver's Office dealing with the case.

My case was XXX of 200X, at <somewhere> County Court, and the address of the Official Receiver is below.

    <Address of the OR.>

A copy of the bankruptcy order is enclosed for your convenience.

Please note that the Official Receiver has requested that all future contact from your company regarding these accounts is reported and forwarded to themselves, and that continued contact with myself may result in Official Receiver taking enforcement actions against your organisation.

Please also note that we are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when the debt is not due.

In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

In addition, your continued telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office.

This type of debt collection method is contrary to the Consumer Protection from Unfair Trading Regulations 2008, in that it is intended to cause alarm and distress to the recipient.

Your methods will not be tolerated.

A formal complaint will be submitted to the relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.

Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

We await your written confirmation that this matter is now closed.

We look forward to your reply.

    Yours faithfully

Are they secured or unsecured debts?.

I was chased by First Plus and their debt collection agency Redcastle after my BR because my home had not been repod. As my First Plus debt was secured they could keep asking for payment until the repo, which is when that debt actually fell into the BR.

IfWishes - thanks for that letter from Fermi (I better keep it, just in case)
  • Unescured, creidt card debts with them they gave me 4 cards and owe them over 10K

Ah - unsecured. They should not be chasing you then!

There's really nothing they can do.

It's strange though - my unsecured debts amounted to over 70K, and I've not heard a peep from any of them since the BR.

Hope it all works out for you - keep strong.
