Debt company conflict of interest?

    No conflict of interest and your deposit is not at risk as set-off wouldn't apply here given they are two separate issues and two separate legal entities (the husband's limited company and the wife as an individual).

    Definitely treat them as separate issues and follow DVardys three point plan.

    I would like to think so. But a quick transfer of the tenancy contract - in which OP would have no say and it is just 1 legal entity.... And the separate issues. Well that's what set off is - a right to link 2 separate issues.

    I know what I think should happen - Landlord tries it on and takes the money. OP sues. Judge tells OP's Landlord it is abuse of process. But I can't be confident.

    You're right. It would definitely be an abuse of process but that would be cold comfort to the OP after the fact.

    I don't think OP should ignore because of this (albeit unlikely) possibility. OP needs to send the prove it letter in the first instance.

    Yeah think that's the way to go, now I think he brought the debt illegally as it shouldn't have been sold in the first place (data protection etc)
