Debt company conflict of interest?

No conflict of interest and your deposit is not at risk as set-off wouldn't apply here given they are two separate issues and two separate legal entities (the husband's limited company and the wife as an individual).

I would like to think so. But a quick transfer of the tenancy contract - in which OP would have no say and it is just 1 legal entity.... And the separate issues. Well that's what set off is - a right to link 2 separate issues.... your deposit is not at risk as set-off wouldn't apply here given they are two separate issues and two separate legal entities (the husband's limited company and the wife as an individual).
I know what I think should happen - Landlord tries it on and takes the money. OP sues. Judge tells OP's Landlord it is abuse of process. You're right. It would definitely be an abuse of process but that would be cold comfort to the OP after the fact.

Yeah think that's the way to go, now I think he brought the debt illegally as it shouldn't have been sold in the first place (data protection etc)0
