HR Advice Needed!! Same Job, Different pay

Hi Everyone,

I wondered if anyone could help me out.

My husband has recently gone through consultation period back in October 2011 after his company were downsizing project managers and site managers from 21 to 15 and making them all into project managers, after a succession of tests and interviews he was successful and was offered a position as a project manager, he was asked along with the other 14 to sign a letter accepting the new position or face redundancy but the salary said it was to be reviewed.

After conversations with his boss over 2 years ago he was told he was the lowest paid site manager at that time on the books and his boss was trying to get him a payrise, when he got this project managers job he was told they would be look at reviewing salaries in Jan 2012, (i presume as this is their new financial year).

He has now been told that there will be no payrises for anyone in 2012 so my question is, can they pay all these 15 people different salaries for doing the same job descriptions.

The company have took over another company in the last 12 months so he knows that there are other now "Project Managers" that are on higher rates than him and there are managers that have been with the company for many years who again are on different rates of pay.

I was wondering if anyone knew if they could do this, I have looked on the internet and I do think this is legal its only when it involves a man and a women that Equality of pay comes into it...

Any advice what so ever would be appreciated.

    Yes they can - unless your husband can show that he is on a lower rate of pay due sex / race / disability discrimination.

    There is nothing to stop them from paying him less. Im sure this is more common than people think.

    It isn't even that easy. An employer can pay what they want to whom they wish provided that the reason for the difference isn't based on discrimination. So they can't pay Mary less than Joe because she is a woman - but they can pay Mary less than Joe because he negotiated a higher salary!
