Autorized credit card
I've read some posting so I decided I post my concern and hopfully get some advice.
My business partner gave me an authorized credit card to pay for business expenses. The business did not go well and he end up owing me money ($9,100) because he made a mistake on his accounting. He aknowledge mistake and promise to pay me back on our e-mail correspendense. He never paid me. I tried to mediate and demad payment but was ignored for a year. I used up the maximun amount on his credit card (he is the primary card holder & I am an authorized cardholder) I subtracted $5,000 the amount on his credit card as payment and he still owes me $4,100. He sued me and demanding me to pay the credit card charges. I counter sued on the small claim court demanding him to pay me his remaining balance. His lawyer said that I'm not supposed to used the credit card because we are not business partner anymore and the charges are not business related expense. I used the authorized credit card because he won't pay me.
I never been sued before and I am nervous going to court. My trail date is on March 2012. I have all the bank statement that shows all the activity that my business partner took the money from our business account. Anyone reading this, an advice or comment will be apprciated.

This is a UK site. As you are mentioning $ I assume that you are in the US? I doubt anyone on here will be very knowledgeable about the US court system.
If it were the UK then certainly you shouldn't have used the credit card account and should have instead taken court action against him to try to recover the money you believe he owed you.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Judge Judy would say that you went beyond the scope of permission on using the card (you was only given permission to use it for business purposes). The fact that your business partner did it to you first does not justify (although understandable) you doing the same.Inside this body lays one of a skinny woman

Whose name is the Credit Card in? The companys? or your friends name?
Who owes you the money? the company? or your friend?
Is their a paper trail running showing you lending the money?
Please explain "He made a mistake on his accounting"?
if its his card and he owed you money your counter claim would be succesful.
Any attempt by the owner of the card to prosecute you would have to highlight the £9,000 debt which woudl automatically become part of the proceedings so you would be entitled to a counter claim.
I think he is silly for attempting to recover money from you and will end up costing him the additional £4,0000
