Chrisbur - on 3 seperate occasions during that tax year my OH received BR tax code notifications, each time we rang up to query why this had happened each time we we're then sent an amendment putting the tax code back to 653L, I will check all the payslips later.
Pam17 - thanks for this suggestion to be honest I didn't realise we could do this
Dori20 - We wrote to HMRC back in August last year after receiving the P800 asking them for a detailed breakdown including income showing how this had been calculated.......this is what we are still waiting for a reply to !!
My OH has never claimed ESA when he was ill and didn't work for 6 months he only received SSP (his company do not have a sick pay scheme) and because I work full time we were not entitled to claim anything.
Because of this messing around this is why my OH is swaying towards paying them this money in full (if he owes it) rather than letting them change his tax code to pay this back as goodness only knows what confusion that might cause and then he's not convinced that changing it back (after the amount has been paid) will be straightforward either.
Fortunately my OH has physically recovered from his heart attack and has returned to work however he now gets very anxious very quickly and has very little patience for dealing with these things and I wonder whether it would be easier just to pay the money and be finished with it, every time we ring them they tie us in knots, my OH gets very stressed and worked up so getting him to ring them is an ordeal in itself. Think it might be a good idea to do as Pam17 suggests and try to speak to someone face to face.

This change to BR and then back to a code suggests that during this year the tax office got the idea that your husband had "other income" but on further examination decided that this was not the case. Of course this time it may be something different or it may be this same confusion has come up again. I would say it is certainly worth mentioning this to the tax office and sending copies of the tax code change notices to show that there has been confusion before over this year.0

I would tend - in the circumstances - to go back with a formal complaint.
To the address on the P800 - include the original P60 (copied first) - and clearly headed 'formal complaint'.
Although they've started the process of issuing 2012-13 Coding Notices ....... it's not as difficult as you envisage getting a restriction of allowances removedIf you want to test the depth of the water .........don't use both feet !0
