Aside from the human rights issue, an agent will put you forward for a role if they think theres a chance you will get it, as it means theres a chance of getting their comission
If theyre not putting you forward, it probably means they consider you unsuitable for that role
An agent would most certainly forward your cv even if there is the remotest chance of you being selected0 -

I do dislike the forum procedure, as it would appear that I have not put forward the situation exactly! Sometimes it is amazing what can be read into something you say - a sharp reminder to us all I think!!!!
As it happens, it doesn't really matter as I have a new job starting on Monday, which was via another Agency completely, so, there's no restrictive convenants to consider. Although it would mean that I couldn't use one, and wouldn't use the other if I was hiring staff at this time!
The situation wasn't actually involving a job - although it had done - and yes, I was more than qualified for it, the reason that I didn't get it was that one of the members of staff family was allergic to horses, and I breed them, which wouldn't have been fair on them, and, in hindsight, was probably just as well for this reason! The Agent is unable to even look for anything for me, or have me on her books.
I can understand that a Restrictive Covenant can be laid down to prevent the poaching of clients, but, I do not see that, if a Candidate applies for a position that is being advertised, and is fully qualified for that role - without being aware of who the agent was - this can be legally enforced.
As I said though - for me - it doesn't matter at this time!0 -
