Agency Workers - New Laws re Rate

A wee question now that the new agency workers laws have been changed.
I have been working in my current job for 8 months thru an agency. I am still in training as is quite a technical role and the company have been more pushing for production than training me properly and they seem to take there time at putting my rate up bit by bit. I just got an increase to 9.40. The rate of the fully trained guys is £10.40.
Now i may have picked things up wrong, but i thought after 12 weeks they had to put your rate up to the same as the guys doing the same job. Or does that not apply to me because i am seen as a trainee still even though i have been in 8 months???

They only have to match the rate for the same or broadly similar jobs. If you are still a trainee, then you are not doing an equivalent job.0

They only have to put you up to the same rate as trainees at that place. When you're no longer a trainee you're entitled to the same rate as the fully trained employees.0
