Certificate Of Compliance

Hi Guys

Can someone please explain to me better what this is for?

My lawyer is needing me to sign a consent form for HM revenue and Customs so that she can try and get some of the money from the sale of the marital home. She needs to try and get this from my soon to be ex husband. (long story) It's only £3000.

However, despite him writing to her and saying that I can have the full amount of the money, apparently this isn't enough, and he's refusing to sign his consent for a Compliance certificate! So this means that I can only now get half that amount?

    Never heard of it, I'm afraid. Why would HMRC be involved?

    Is it to do with SDLT (Stamp Duty / Land Tax). How is the house owned (joint / tenants in common) - and is this the only property?

    Any more detail you can add?
    If you want to test the depth of the water .........don't use both feet !

    Thanks for replying.

    What happened was that the marital home was repossessed after husband did a disappearing act a few years ago.

    I eventually found out that there was a sum of money left over from the sale and because my husband at that time couldnt be traced, I couldnt get anywhere as his signature was needed.

    Now he has been traced (working abroad allegedly)and he sent my lawyer an email sayng he agreed that I could get the whole amount ( he owes thousands unpaid maintenance money)
    However, my lawyer said I need to send her a signed authority for a certificate of compliance before I can get any of this money and, because he wont sign one, I can only get half the amount.
    She said something about it being a check to make sure my taxes were in order or something like that? Dont know why as I only have a small part time job.

    Still doesn't ring any bells I'm afraid. I can only assume it's a document required by whoever is holding the residual funds from the sale? And who require evidence you're entitled to the whole of the equity - as the house was presumably jointly owned. I can't see how it is connected to HMRC
