ccj and losing job

Hi got ccj then they got charging order for Rbs loan owe about 23,000, anyway last time in court 2009 they said 114.00 pm on wage of 1200pm now I'm on 340 pm they likindly lowered It 100.00 they said can't make IT lower. Are they right? It's with Irwin Mitchell some solicitor firm c. I'm struggling to pay for bills and food. I'm scared they will enforce charging order if I go back to court to lower repayment ( but I did read they can't serve a CO on property in joint names which it is ) any help would be great thanks

    Who kindly said they'd lower it? the solicitors?

    If your circumstances have changed and you cannot afford repayments then you need to go back to court to get them lowered.

    If the house is owned in joint names and the debt is just in your names then its only a restriction not a full charging order - and there can be no forced sale on a restriction.

    Hi yes they Irwn Mitchell said we can lower it by 14.00 I cried. Do I just go through the court or do I inform them? Thank you

    consumer action group are very very good on these things...get over there.
    It is nice to see the value of your house going up'' Why ?
    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

  • but do you not now get tax credits etc etc to bring your earnings up, as obviously no one could survive on just 340 pm

    Hi yes,we do get child tax credit of 40. and c benefit.of 80 so I guess I get 460 but that goes into partners account so I don't spend on rubbish and always gets spent on food. my partner earns a decent wage but has a.lot debt. He helps pay extra when he can.
