Eviction Notice

Hi all,
I have an eviction notice for a secured loan that is due to complete in Mar 2012. I am in arrears (due to job losses and unemployment). I am going to complete a N244 form and issue to court to go before a judge (again, I have been before a judge 3 times regarding this debt). The debt is nearly paid off ( I was about 10k in arrears and am now about 3k in arrears plus normal payments).
I want to request a 2 or 3 month extension to repay.
I had been paying 1k per month, until losing my job. I am back in employment now and able to continue paying, but alas, I will need a couple of months longer to pay off. (There is also the matter of charges etc on the account, but that is another matter and I am looking to reclaim PPI, although I took the loan out in Sept/Oct 2004).
How do I request a 2/3 month extension in order to repay the loan?
Also, when I was last before the judge (Apr 11), I spoke with the solicitor before hand who said that the £7k of charges are what would have been applied had the judge granted eviction.
Any advice would be gratefully appreciated.

Sorry to rain these questions down on your head but a little more detail is needed.........
What happened at the last court hearing? What did the court order say? Have you complied with the court order, and if you haven't did you apply to the court to vary it? Does your opponent know about your recent difficulties. Furthermore, what exactly have received - is it a warrant for possession?0 -

I second that. Any debts in which you could lose your home require profressional help go to the CAB this morning.0 -
All I want to know is how to request a 2 month extension to repay. Do I do this on the N244a.
As I said, I have been before a judge 3 times before and I have had valid reasons (as I have this time). I have never been to CAB or shelter, although I have tried to get to see CAB there is about a 3 week waiting list and these hearings get 2 weeks notice or so.0 -

Go and seek professional help immediately. Now. Pronto.

Go onto the Law Society website and enter your postcode and state that you need a lawyer who specialises in housing issues. They will issue a list of those local to you who you can telephone to ask for advice a.s.a.p.0

Hi Big Pellett
It's not simply a case of asking for more time to pay, as you appear to be facing imminent eviction you will need to take urgent action to prevent this and therefore you will need to apply to suspend the warrant as well.
Before you even attempt to do this you should take advice. I appreciate that you cannot get a quick apointment at the CAB, and would therefore suggest that you contact Shelter. They have an advice line which is open until 8pm each weekday (weekend times may be different). Their telephone number is 0808 800 4444.

If you have been before a judge 3 times already this suggests you have defaulted on 3 arrangements which lessens your chance of getting a suspended possession order again this time.
Go get some professional assistance pronto. You should also get in touch with the council and make a homelessness application if appropriate in case the judge doesn't agree to suspend.Total 'Failed Business' Debt £29,043

Yes, ask the CAB receptionist to tell the session supervisor that you have a notice for eviction and need to see someone straight away. They will fit you in.0 -
