Free prize draw terms and conditions

1. How to Enter: The free prize draw will begin at 8:00 AM Central Time ("CT") on December 13, 2011 and end at 11:59:59 PM CT on January 31, 2012. Participants may enter online. No other method of entry will be accepted. Entries must be received by 11:59:59 PM GMT on January 31, 2012 to qualify for entry into the free prize draw. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the authorised account holder of the e-mail address submitted at the time of entry. The authorised account holder is the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organisation that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. All entries become the property of Ontrack and will not be acknowledged or returned.
2. Prize and Odds:One winner will receive an Apple® iPad™ 2. The odds of winning depend on the number of eligible entries received. The prize is non-assignable and non-transferable and may not be transferred or substituted or redeemed for cash, except at the sole discretion of Kroll Ontrack, who reserves the right to substitute the prize for one of equal or greater value.
3. Winner Selection/Notification/Acceptance:The award of the prize is subject to compliance with these Official Rules. One (1) potential winner for the prize will be selected from among all eligible entries on or about February 1, 2012. The potential winner will be selected by committee and judged based on the uniqueness of how the data loss occurred and how it may have impacted the winner and/or business. The potential winner will be notified by email and/or phone, at the sole discretion of Kroll Ontrack, within 10 days from the drawing date. Potential winner may waive their right to receive the prize. In the event that a potential winner cannot be notified within 10 days after notification attempt, or if a potential winner fails to comply with any requirement of these Official Rules, including failure to complete and execute a requested authorisation for Kroll Ontrack to use the data loss story within 10 days of prize notification, then that potential winner's prize will be forfeited, and an alternate potential winner may be selected at random from the remaining eligible entries received. Unless prohibited by law, acceptance of a prize constitutes permission for Ontrack and its advertising and promotional agencies to use winner's name, likeness, hometown and biographical information for advertising and promotional purposes, worldwide and in perpetuity, in any and all forms of media, without additional compensation.
4. Agreement to Official Rules:By entering the free prize draw, each entrant fully and unconditionally agrees to be bound by these Official Rules and by the decisions of Kroll Ontrack and free prize draw judges appointed by Kroll Ontrack, which are final on all matters pertaining to the free prize draw. To the extent permitted by law, the free prize draw is governed by the laws of the United Kingdom and Northern Ireland and for entrants from that country, by those of the Republic of Ireland.

Ontrack, any telephone network and service providers are not responsible for any problems or technical malfunction of any telephone network or lines, incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any Web site or on-line service, or any other error or malfunction, or late, lost, illegible or misdirected entries. Entry materials that have been tampered with or altered are void. If Kroll Ontrack determines, in its sole discretion, that there is any suspected or actual electronic tampering with the free prize draw or if technical difficulties compromise the integrity of the free prize draw, Kroll Ontrack reserves the right to void the entries at issue and/or terminate the free prize draw and conduct a random drawing to award the prize among all eligible entries received as of the termination date.
