Hi (newbie lurker but never had to post before!)
I have a situation at work whereby I was initially employed to do Job A and to provide cover for Job B when the post holder of Job B was on holiday etc.
Postholder of Job B retired and the company made the decision to not replace the person, but instead asked me to take on some of the reponsibilities of Job B alongside that of my Job A, putting them together to make Job C. I received a significant pay increase for this.
Now Job C has moved location and there is no need for me to carry out the duties of Job B (as these related to the building where Job B was based), I am still between sites (8 miles) but from 1 March will be required fully at the other site, meaning that I am no longer required to carry out Job B - which is infact being outsourced to an external company.
With this in mind, my company spoke to me before Xmas about the possibility that I would no longer be required to carry out the duties of Job B, and as such would be looking to come to an agreement to reduce my salary. So my questions:
1. Can the company reduce my salary? Does this have to be with my consent or can they enforce it?
2. Should I be made redundant from Job B? I dont have 2 separate job titles, its all under one, and I guess my company would argue that the job in the main is remaining the same, excluding said Job B duties.
3. How can I negotiate my salary if they insist it has to be reduced, I anticipate they will want to cut about £10K

1) Yes they can but it has to be by agreement. If an employer reduces employee’s salary without consent then the employee can either resign and claim constructive unfair dismissal or continue to work “under protest” but sue for compensation for the loss of the reduction in salary. However as usual there is a get out where the employer can terminate your contract of employment by giving you notice and then offering you a new one on the lower salary.
2) No as it was merely additional duties taken on on a temporary basis.
