Rockwell DCA

Hi I have received a letter from Rockwell chasing an old debt which I believed to be statute barred. I sent the SB letter and they replied saying the last payment was received in October 06. The last payment made by myself was through CCCS in Feb 2005. I have spoken with Lloyds who agree with Rockwells date but won't give any more detail other than to say the debt was sold in Dec 07 to Tessera. Any ideas where to go from here?
Thanks

Resend the SB letter, but add in those points.
Basically saying that they must prove the payment that they claim and that YOU made it, otherwise you demand that they bog off. If they wont prove it, then report them to the OFT, trading standards, and complain to the FOS.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Am I correct in thinking that it is down to them to prove I made the payment? I have asked Rockwell to supply details of the payment..who it was to/how it was paid and where if possible. Could it be a payment allocated incorrectly?0

Yes, it is.
See the points raised in the previous link.
Debt collectors frequently claim a "phantom" payment that conveniently would prevent a debt being statute barred.
When pressed, these often turn out to have been a "mistake" on their part, or a payment made to sell the debt between companies, or some other such lame excuse.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
