Job applications and criminal record

I also work in HR. I used to work for an employer where CRB checks were mandatory, and if someone had an offence we'd look at the relevance of the offence to the role being applied for and how long ago it happened. So having a conviction would not automatically preclude you but if it happened recently and cast doubt on your character/integrity then it probably would. Every time you go for a new job, you're going to have to weigh up the risk - do I lie and hope I get away with it, or tell the truth and risk my application going straight in the bin? Whilst you may get away with it if you apply only to jobs not likely to have a CRB check, be aware that many employers these days require a check eg transport, financial services plus of course anything where you go near a child. Also don't presume that just becuase they don't do a check when you start they will never do one. I worked for an NHS trust that introduced CRB checking for internal applicants and caught quite a few people out that way.0

The big problem I have is that last year I was convicted on a section 5 public order offence, aparently I used the 'F' word in public (I kid you not) I am completely innocent of this however the Magistrates decided to believe the policeeven though the CCTV footage didn't match the police's version of events (can't say too much as there is an appeal going through). Anyway back on topic, all the applications I've had ask specificaly for me to declare any crimal record excluding spent convictions, as I consider myself completely innocent can I tell a little white lie here? are they able to check? none of the jobs require CRB checks.
This is one of those 'damned if you do, damned if you don't situations'.
Lets presume the conviction stays.
Do you state that on the application form? In the real world how confident would you be about your application not instantly being binned especially given the economic circumstances that we find ourselves in.
If I had super duper skills that everybody wanted then I'd feel more confident and declare.
What would I do? For run of the mill jobs I'd fib and take my chances. I'm not comparing the two but look at the unemployment rates amongst ex-offenders.
Somebody close to me got sacked for gross misconduct for alleged theft working in retail. She got a job in an almost identical environment soon after. Did she declare. Absolutely not. She has proved her worth so the employer is very unlikely to check.
Either way, best of luckAs surely as night follows day capitalism will come crumbling down. On a mission to secure a just and ethical society.0 -

Realisticaly, I've got a criminal record for alegedly telling someone (police officer) to 'F' off in public, should this really be a criminal offence, bearing in mind it is not an offence to tell a police officer to 'F'off? How many people on here have at one time in their life told someone to 'F'off in the street or in public? Why should something so minor have such a detrimental effect on ones furure? Section 5 Public order is a joke as it is open to exploitation by bad police officers when you say somthing they don't like.I hate football and do wish people wouldn't keep talking about it like it's the most important thing in the world0 -

But having a rant about the injustice of it all won't help your immediate problem. And even though you clearly aren't liking the comments of people who are not agreeing with you, I personally think it is better to get practical help than sympathy. YMMV.
Options
a) wait until you get your appeal. You win. No further issues.
b) only apply for jobs with no CRB and choose not to declare. Live with the stress of wondering if they will CRB in the future and how you are going to explain the time off for court. Or don't stress. Up to you.
c) apply for jobs you want that nay have a CRB, and come up with a much better explanation than the one you are giving here
Feedback on how your explanation sounds
a) busybody - telling police how to do their job
b) gobby - ended up in a section 5 instead of walking away
How can you rephrase what happened without flagging these danger signs to employers?Debt free 4th April 2007.

Actually, you are the only one whose comments I don't really agree with, as one person said re your 'implauseable comment, 'you must be incredibly niave'
As for Busybody and gobby, neither, I was caught up in the situation and singled out as the soft target.I hate football and do wish people wouldn't keep talking about it like it's the most important thing in the world0 -
