Help with Capquest

Dear All,

I'm having trouble with a company called Capquest. They contacted me concering a debt with Tesco card.
They asked me for all of my private details to start with, which i did not give them as i had no idea who they were.
They said that they were working on behalf of Tesco and that i need to pay them direct and amount of money each month and then would transfere it to Tesco. Having never been in this type of poistion, i asked them to supply me with a letter explaining who they were, what the payment was for ect.
They turned round and said that they do not send letters out unless i sent them a sign letter asking them to send me this information, which i thought was very funny at the time.
I told them that i would not agree to anything until they sent me this infromation concering there company and also the debt. I have never recivced a letter from them informing me that they either own the debt or that they are working on behalf Tesco. I have read alot concerning this company and the fact that they buy the debt for a faction of the price but charge you the full amount.
I have been told that i need to send a letter asking for CCA, what is a CCA and what do i need to put in to this letter asking for this information. i have had a letter today from them with the following information in the letter:

Dear Mr XXXXX
Our Client XXXXXXXXTesco
Account numberXXXXXXXXXXXXXXXX
Balance XXXXX

We thank you for your emailed correspondence aand respond as the follows:

"We have received your request for evidence of this debt. Please be advise that a copy agreement will only be provide to you if the request is submitted under the trems od the comser credit act 1974, sections77-79. Under this act a £1.00 fee must be provide.
If you still requier a copy of the agreement please sign and submit your request in writting as detailed above with the enclosed £1.00 fee made payable to Capquest investments Ltd.

I have been read that i should send a letter withh this fee but not to sign it, and also they are meant to send the orgainals out to me not copies is this correct.

I stopped answering the phone to them because they are so nasty and just keep putting the phone down whne i ask question.

Can any one give me a good template and fed back as what my next step should be with this company.

Thanks

    Hi and welcome?

When you say they contacted you - by phone or a letter?

I would not send a CCA request to start - I would send a prove it letter to start with - which gets them to prove you owe the money and prove they have a right to collect it.

Prove it letter template here - http://forums.moneysavingexpert.com/showpost.php?p=11570893&postcount=2 this is the first letter to send whenever a debt collector contacts you. Send in the post (not by email) and send recorded deliv so you can prove you've sent it.

You are right capquest like all debt collectors buy debts very cheaply from creditors but the debtor still owes the full balance, thats how they make their money.

Wait until they've responsed to that letter before you consider a CCA request. CCA is the consumer credit agreement - does not need to be the original, copies are fine, or even a reconstituted version of the original agreement.

Template now added to post #2 (you were too quick for me!).
Better if you have received a letter as that template refers to a letter.

  • Dear All,

Help and advice is need to concerning the above Company again.

I sent the letter that was attached to my last thread concerning this company. They have sent a letter back stating the following.

Please be advised tha you contacted our collections deparement on the 21st Novemebr 2011, advising that you were paying this debt be direct debit previously to the client and you were advised of the lat payment our cleint recieved. You then went on to put this account on arrangment with capquest for 100 payable monthly. Therefore acknowledgeing this debt and accepting liabitly.

If you wish to dispute the is debt, please write in full disoute details and supporting documentation"

The first part is completly un true, they contacted me and told me that they were a derpartment within Tesco card and i need to make a payment to them.
Ii did make the payment as i thought they were Tesco which after i found out that they were a debt collecting company.

I have not made any further payments to them and i have infromed them why and that the account is in dispute as i do not owe there company any money.

Can some one help me concerning my next step with these guys.
