    Hi,
    thanks for getting back.
    surely there must be something?
It can't be right that he can drive around and not have to pay?

wouldn't the loan be secured on the car?

It's registered in his name BTW.

My credit record........., we had debt when we split which I'm paying off now so it isn't very good anyway.............

    Paula

The loan would not always be secured on the car.

    ask black horse!

let us know what they say

    there are two types

HP over the car, where they can take the car back, or a personal loan - where the car is named in the documentation. but for no real reason.

If the money has been coming out your bank, then its your car.

The finance is in your name

    its your car

He may be the registered keeper, that means nothing, its your car, you can get a new v5 in your name (espeically if the finance is yours) and then he is in possesion of a car thats not his

These things always get messy :(

    What a mess !
If he wont pay, you may be better asking the finance company to repo the car sooner rather than later, you can not sell it for 3 years and if he smashes it up and does not have fully comp insurance you will be left holding the baby and the bathwater.

Providing the car is in good working order it may help mitigate your losses.
If the Ex pipes up, then let him negotiate a new contract in his name for the loan.
One thing is certain, you will be out of pocket, I would say your better biting the bullet as soon as possible.
It wont matter if he has sold the car the HP company will just repo it from the new keeper as it was not his to sell, let him worry about that.

only if it was on HP

black horse do two types of car loans, one which is HP one which is a personal loan!
  • You own the car. You own the finance. As has been said above you are responsible for paying this debt.

What you must be very careful with is - he might sell it onto someone who is impossible to trace. You'll still have to pay for the car.
  • My advice is to recover the car

Get a loader (with dollies) the company will know what you mean

Get the car towed to a place of safety. even a dealership

    You have lost the keys

There is the finance doc, proof you own the car!

get new keys cut (200 quid)

    sell car
