sick whilst on annual leave

I have a bit of a dilemma, advice please. I am returning to work after maternity leave, and am taking some annual leave before I actually return. My maternity leave has currently ended and i'm on the annual leave bit. I've been very ill since new year, don't want to say the condition but it's more than your average cough or cold and I've been completely bed bound. Doc says will last another week or two. Anyway I saw the doc today and he's given me a sick/fit note for a week. I want to send this in to work and take this week as sick and get the holiday days reissued (I don't know how I'll be next week, I'll deal with that then.Hopefully the meds will have kicked in by then) But as I've been off on maternity for a year, I'm worried this will be seen as taking the p***. However, if I don't do this I'll be spending my holiday days in bed ill. I know there is provision at work to regrant holiday days if sickness whilst on annual leave is covered by a sick note so I'm pretty sure I can do this, but does it look really bad? What would you do?

I think they will - I had a situation a year ago, and I never even asked for it, HR told me straight away it would be credited to me.
If not, it is up to you how far you want to take it.0 -

I would suspect they will credit the holiday, but still think you are taking the !!!!.0 -
If I were bothered about a career I'd take it as holiday, If it were just a job I didn't care about I'd ask for sick leave.Debt free 4th April 2007.

Agree with the others. From a policy perspective, fair enough. And of course you can legally accrue the leave.
But given that this is AL that you accrued whilst off anyway (ie, you didn't work for it), I would also see it as taking the pee. You've had a year (?) off, are on holiday for a further 4 (?) weeks, now calling in sick for at least the next week, and want your holiday back so you'll be off for another 4 (?) weeks which is accrued leave you weren't at work for...
Not the best way to start going back to work. I'd write it off as one of those things.

Legally you have every right to take them back as holidays but morally do you think its right you have accrued holiday whilst not working, then go off sick and then get the holiday back...The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!
If I give you advice it is only a view and always always take professional advice before acting!!!

Morally I wasn't sure which is why i came on here and asked the question. Actually it's not really about morals so much as not wanting to p*** off my boss/colleagues, no one wants to be ill thought of at work. So, I am glad I came and sought the opionion of my good friends on MSE before coming to a decision, I will probably just leave it and take it as holiday. I'm feeling a little better today in any case, so may be over the worst of it.0

Thanks. Not better better, I'm still ill, but not as bad as before. But won't feel so bad being sick on holiday if I'm on the mend. Also having thought about it some more, it's not like I was about to get on a plane to go somewhere exciting, in which case I would definitely have been asking for my holiday back, I'd only planned (before falling ill) to be sat at home where I've been for the past 12 months anyway, so I'm not missing out on too much.0
