Another Capquest problem - First time poster

You've done the right thing in sending a 'prove It' letter rather than a CCA - mobile contracts aren't covered by the Consumer Credit Act.
If you've got proof they received the first letter, and they've not sent the proof you've requested, then that's their problem and not yours.
And no, you shouldn't send them any documents they request, or provide any signatures to them - or speak to them on the phone, for that matter.
You've put the burden of proof onto them, which is the correct course of action.
Also, I'd remove your name from your post.
Thanks FTW took abit of pressure of me. The thing is though it wont stop them sending more letters and threatening legal action and adding more charges. I just want to know why I owe X amount, im not disputing the fact that I might owe on the original contract account. I want to know what im paying into first you know? They wont send me the details and I wont give in and just pay! Do I send another 'prove it' letter or just ignore them? What can happen if I do the latter?0 -

Let them send their letters - if you have proof they got your letter, then you have a legitimate dispute with them.
Any letters/calls you get from them which has nothing to do with your request, make a formal complaint to the OFT and also the Financial Ombudsman Service - and report each separate breach as a new complaint (might be worth keeping a copy of a saved letter for that).
Also, if their letters threaten charges, then that would be sufficient reason to report them to the OFT in itself.
The OFT Debt Collection Guidelines are worth reading through - interesting stuff.
I'm pretty sure Crapquest would have breached a fair few of the guidelines that's in that document, in their dealings with yourself.I just want to know why I owe X amount, im not disputing the fact that I might owe on the original contract account.
That's down to them to prove it, and you've already asked that question of them.I want to know what im paying into first you know? They wont send me the details and I wont give in and just pay!
It's their money they're p***ing away by trying to badger you - let them. And then report them each time they do it.Do I send another 'prove it' letter or just ignore them? What can happen if I do the latter?
Ignore them. If you have proof they got your letter, then they'd look pretty stupid if they were to take it to court - what are they going to do? Deny ever getting the letter? Pretend to be unaware that you've asked for a breakdown? And even going to court for less than £200?0 -
I am in a similar situation as i also had to cancel a T mobile contract early. I know i only had a couple of months left of on it so it should only be about £80 tops but they are asking for over £500!
I've never had to deal with debt before and i am not very good with it but i do know that the worst they can do is take me to court and it would probably cost them a few hundred to do so, there for i personally don't think they would go that far as it would be pointless.
I didn't give them any of my bank details but i agreed to pay £1 per month and i was doing that by paying into a bank with their details and a reference number and i was late paying it back over new year as my daughter was in hospital and they had the cheek to ring me and be rude to me on the phone for being late after i had explained the situation. I also had them trying to ring me whilst i was staying in hospital with my daughter but i ignored them. A couple of days ago i pad £6 in change to try to get them off my back a bit but i still had a rude phone call from them today demanding more money after the agreement and they had also tried to say i haven't paid when i clearly did and have a receipt to prove it.
I've been reading a lot of peoples comments on this company after the phone call today and i have decided to ignore them and i am not going to pay them another penny. They cannot send bailiffs round without taking to me to court first and if they did take me to court i will have them done for harassment as i still have the missed calls on my phone whilst in hospital.
I am not worried about it at all i am just so annoyed with them.0 -

If you're paying it off, even slowly, they'd look pretty stupid taking it to court.
Also, don't speak to them on the phone. If they have anything to say, let them do it in writing.0
