That's good news - as it's fairly certain the part time employer was therefore reporting your data to HMRC. As you then completed a P46 at the 'main' job, HMRC were aware from that point that you had double employment.

Their systems weren't capable, at that point, of electronically summarising it all. But now are - with the result you see on your P800. But this now seems a much clearer case where ESC A19 applies as they were aware you had 2 jobs during 08-09. And have failed to do anything about it in the time limits they set themselves for action. (despite not really having the tools to do the job at that point!)

Follow the 'Making a claim' para on the link I provided earlier. And press the point that they were aware of the part time job from a P14 (end of year summary roughly equating to the P60) submitted by that employer and a P46 via the 'main' employer. And - that you were of the belief everything was in order having discussed it with the employers concerned.

Thank you so much for this. I truly appreciate it. I genuinely was of the mind that it was all sorted, i queried it like I said because I had been worried. When both employers said it was all correct I took their word for it because as far as I was concerned they were the ones in the know about this being the ones paying and having accountants and a payroll system in place. I also thought that the way the hmrc worked was how it is now, as in, all the systems tying in together. I know this is down to me as well because I didn't check but I really didn't think I had to.

I agree with Mike on this. Have a look at the other Esc A19 threads on this site, there are many of them and the current score is probably about HMRC 1 Taxpayers 20. You can have a go by phone, more typically it takes 4 or 5 letters before HMRC finally admit how rubbish their systems have been and bite the dust on the P800 bill. First get your facts straight on exactly what happened in 08-09. It's important that you can show you've behaved "with clean hands" and had "reasonable belief" your tax affairs were in order. I am not doubting you, not for one moment - but give HMRC some wriggle room and they will wriggle like hell!

It's a disgrace how the tax system has been operated in recent years, and I make no apologies for the strapline at the bottom of this post. In the 21st Century it was acceptable for them to raise this matter with you 3 months after the end of the tax year, taking nearly 3 years is taking the Mickey! If they are not capable of running a drinking session in a brewery they should throw these P800s in the bin.

I will have a look thanks. I did ask on another forum and got told tough, my fault, my issue, pay up, blah blah
Blah. I am so glad I asked here because I have had decent advice which is what I so desperately need. If I have to pay up I will, I have no reason not to as I am owe it, this isn't so I can get out of it, but I couldn't help but think they were partly at blame as well.
