Littlewoods passing debt to n.d.r.l. What can they do?

I urgently need some advice please. Got into a bit of trouble paying my little-woods bill, (they did send a few demanding letters) so I called them and asked them to lower my payment plan. They said they couldn't lower it as low as I needed it and I needed to go to the Citizens Advice Bureau to form a payment plan that way:(. I work very strange hours, so trying to pop in to see them isn't as easy as I would have hoped. I received a letter today 06.01.2012 saying that if I did not phone immediately to make a payment they would be passing my debt on to National Debt Recovery Limited on 08.01.2012. I got home too late and they were shut. I have a car on finance and know nothing about debt recovery procedures. Does anyone know weather they will immediately take my car as form of payment, or weather I can agree an arrangement first. PLEASE HELP :(

  • the debt company will sort out a payment plan with you, they wont just come straight to the home.

    May i ask how it come about with Littlewoods?? as im having the same with them at the moment, there saying i missed payments yet there on my statements showing i paid for them.

    Safe to i wont be using them again in the future as they now claim i owe them £499

    They cannot take your car.

    First off they'll write to you and try to frighten you with threats of cour -these are meant to firghten you but don't let it - they cannot have more than you can afford - but you do need to start paying what you can afford. If you write back and set out how much you can afford to pay a month and then set up a standing order for that amount they are not likely to take more action.

    Regarding the car - in theory if the did take court action and obtain a CCJ it would only be if you didn't repay the CCJ / keep up with court ordered installments that there would be any chance of them appointing bailiffs. Even then if your car is on secured finance they couldn't reposses it as it technically belongs to the finance company not you (if its unsecured finance then they could reposses) - but thats a long way down the line from where you are now.

    If you want to speak to one of the debt charities and its hard to get to CAB you can always try CCCS or national debtline who both give phone advice up to around 8pm each day I think.

  • Also it's best to keep things in writing so you have evidence of what has been said on both sides. You are not obliged to deal with them over the phone.

    NDR is part of Littlewoods so really the debt hasn't gone anywhere.

    To give a bit more context can you tell us

    1. Roughly how much is owed
    2. when you first started ordering from Littlewoods (month, year)
    2. do you have other debts

    regarding the CAB if you check here you may find your local bureau has a phone service or in fact requires that you phone before visiting them.

    I have had plenty of dealings with NDR for my account.
