A friend of mine is going to see his parents who live in the Ascension islands which isnt easy in getting to as some may know, His company holidays are from Jan to Dec. He is taking all of this years holiday entitlement (22 days). and wishes to take 13 days from 2013 allocation again 22 days. He has been told he can take the time off in January however he wont be paid for it as he wont of worked enough to be entitled top these days pay. He has worked for the company in excess of 8 years. He is as everyone else is of the opinion that firstly hes given enough notice hes not borrowing any holiday and as the holidays are from Jan to Dec cant see what the problem, He has said that obviously if he leaves the company before he has worked enough to acrue these days then obviously he will owe the company etc. He is paid monthly i cant see what the problem is nor can anyone else
Any suggestions anyone?

Because
1) if they do it for one, they have to do it for all
2) by law you have to have 5.6 weeks holiday per year - this isn't averaged over a number of years - it is per year0 -
Things happen, if he was paid all these holidays and something untoward happened or he decidd to stay there,
Cant blame the company reallymake the most of it, we are only here for the weekend.
and we will never, ever return.0 -
They have said they wont pay him as if he doesn't come back they have nothing to claim it back from. Therefore they would have to request the refund from him and or take him to court for the ammount owed back. They do not have any legal obligation to pay him all this holiday as you only accure it as the weeks pass. He is lucky they are allowing him to take such a long period of leave to be fair.0
