When unfair dismissal changes to 2 year will the already employed be 1 year?

This is hard to explain in the title as it does not give enough space.

Say I started work on 31/10/11. Then say in april the law changed to two years. Would by qualifying period still be one year, seeing as I was employed BEFORE the new rule came into play.

Answers please.

BTW not that anyone cares about my opinion but I think it is a stupid and pathetic rule.

    So are you saying my qualifying period would be 31/10/13 not 31/10/12?

    But surely if the change came in april, then you started employment before the new law so should still be following the old one?

    Much like the IB and ESA changeover

    Yes, your qualifying period will end on 10/13. This is because the two year rule would be the effective law at the time of the unlawful act.

    It was bad enough being on egg shells for 1 year let alone changing it to two.
  • Try not to think of it as being on egg shells - my experience is that, if they want to get rid, they'll do so irrespective of how you act. Plus you never know, the law might not change ... :o

    Wethink. Since the regulations haven't been published we don't know. There's already countless threads on this so not going to repeat them again

    Nothing is definite until it happens. The government have said it will and I can't see who is going to stop them. But I repeat, we do not yet have the draft regulations and so we do not know exactly what they will say. The government needs to try to find a way to prevent what happened the last time they did this - and we don't know whether that will impact on the regulations, or how.
