on the positive side they have acknowledged receiving your letter. they are not really committing an offence under the act until 30 days.

Write to them again (using recorded delivery) stating that the £1 was for a copy of the credit agreement and that you DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY - put it in bold so they really can't miss it! What they are trying to do is take the £1 as a payment so that the 6 years starts again!

Somewhere on the site (not sure where though, sorry) there are template letters for writing to DCAs - just make sure that you don't acknowledge any debt to them until you get a copy of the credit agreement, and remember that if nothing's been paid for 6 years or more it is statute barred.

personally i would write something like :

    dear sir,

I wrote to you on the 23/01/2007, asking you to send me a copy of the alleged credit agreement. I enclosed the statuory fee of £1 and I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY.

I am in receipt of your letter of '...date...' which does not contain the require information.

As you know unless you can provide a true copy of the alleged agreement it is not enforceable in a court of law. You will also be aware that your failure to provide the requested agreement within 28 days is an offence.

    I await your written reply.

obviously you will send it my recorded delivery and track its delivery
