Hi and Help! i'm in a pickle

Hi all

I’ve got myself in a pickle and my head buried in the sand.
I shall try to keep it brief, I lost my job in march 2009, I was out of work until July 2009 and started a job with a lower wage as I had no choice and the joys of jobcentre pressure I took it and I am still employed at the same job, I approached the cccs who arranged DMP .
I had a loan with ge capital and various cards.
December 2009 ge decided out the blue to sell my load to link financial, they then took me to court and gained a charging order against our house which we own outright , then my mom passed away in august 2010 out the blue who we was careers for and our house was adapted hence the loan from GE for a conservatory to add more space so not for luxury due various hospital equipment for mom.
My wife was her career and only received £50.00 per week from the government. Since mom passed away she got a part time job which does pay more.
I was paying £200 to the cccs which mom was helping towards since she passed away they agreed until I was in a better position to pay £30.00 per month which I have continued to do.
However they keep badgering for a review and I’ve ducked and dived because I feel uncomfortable with them because a comment a judge made when the charging order was placed thanks to link financial , so ever since I’ve not trusted them yet people like the CAB have told me that’s who they refer people too.
Link are adding a ridiculous amount of interest every month yet the cccs said they would sort that but only after I spoke to their benefits specialist who I felt treated me like a piece of dirt and wanted to know this and that , my wife is disabled but does not receive benefits because they say doesn’t qualify (she is amputation of her leg from knee down) and she’s appealed and applied so many times and been knocked back she won’t go through it again as its very distressing and we get nowhere but the cccs benefits person refused to progress any more with us unless we apply again , which means there promise of sorting link out came to a halt.
Anyway I’ve got various other creditors such as Barclays bank who have sent letter from mercers and there other company who I’ve found is connected to them, now there have sent me the a letter saying if I don’t pay up the whole bill by the 8th then they will send a debt collector and/or take me to county court.
I owe approx 25k sorry its long winded and a lot of is my own fault but I don’t know which way to turn or where to go, I’m still paying £30 to cccs but I just have a lack of faith in them and why when they look at the income why do they want to take in my sons child allowance as its for him not paying debts.
cccs are not aware of my wife having a job as this distrust in them , and the fact that from previous conversations they hardly leave anything left for us to live off , well thats how i feel.
There are other issues but this one is bugging me
Any advice would be very appreciated.
Thank you (hope it makes sense)

    Hi verved,

To be honest I don't really have any advice but didn't want to read and run. You and your family have obviously been through a really stressful time. I am surprised to hear about your experiences with CCCS - I've had nothing but great service from them. Would it be worth trying to speak to a different individual in CCCS - one of the aftercare team, or you can ask CCCS debt advisors queries at the thread at the top of this page. Alternatively, might you think about approaching Payplan to set up a new DMP with a new provider?

I guess you might need to come clean on everything and see what the best option is - whether this is best done with CCCS or a different provider/charity I don't know. CCCS does have that online tool thing that you could fill in anonymously, with your wife's income as well, and see what it churns out?

Anyhow, with regards the more urgent problem of the creditor wanting all the money etc - there's various stages they have to go through before you end up with people at your door and I'm sure someone more expert than me can give you infor about that, and will be along soon.

Best of luck with it all

Ok, let's take this one step at a time.

    1) speak to CAB and get this issue with the interest sorted. This is a priority and you should start this process immediately. If they still insist on sending you to their 'specialist' you can remind them that you are under no obligation to apply for benefits and that this is not the purpose of your visit to the,. You can, if you want, point out the unprofessional behaviour of the previous advisor and that you have been waiting quite long enough to reolve this situation.

    2) write to your biggest/troublesom creditor and explain the situation. That you are in this through adversity and not incompetence and you would appreciate there assistance and understanding.

    3) what did the judge say that upset you ? Is there more to this?
    4) how much is the charging order for?

    5) what steps are you taking to improve your circumstances and increase your income? How limiting is your wifes' injury and can she find a better job perhaps? I cannot judge, but from a purely personal point of view, a lost leg seems an annoyance and not nearly as serious as some other disabilities, especially with modern prosthetics.

    6) Can you post an SOA, perhaps we can see things you havnt thought of?
