Need Some Help - Red debt collection

Hi Everyone,
I was in the UK between 2002 to 2005 and returned in Jan 2011. I had some debts during that time for Mobile Contracts and Credit Cards. Last week I started receiving letters at my house address asking me to pay up for the debts from RED Debt Collectors. They harassed me over the phone that I must pay this and since I had no knowledge about how to avoid them I paid some amount to RED....
I have asked them to provide documentation about the payment request but nothing yet. I wasn't aware of this forum till today and need your help.
How can I avoid the next installment of the payment which is due in Feb?

You need a new thread urgently; not to hijack a very old one.
And you need some very specific dates; exactly when did you leave the Uk in 2005?If you've have not made a mistake, you've made nothing0 -
Can I just contribute please do not sign your sign your name it should be printed preferably.
From what I have read elsewhere do not pop signatures on0 -
if the debt was 6 years old before you made a payment then it is still barred. however if its less than 6 years then they have just got themselves 6 more years to chase you. you need info on this debt. never pay anything untill your very sure you owe it. being bullied on the phone is not a reason to give them money. send them a prove it letter, followed by either a barred letter/or cca depending what the debt is. the best way to deal with phone calls is to refuse to answear their security questions.0

Check your credit file and also trustonline incase they have gone to court and you have a CCJ do this immediately... If nothing there them most probably SBI all have learnt is from others on many sites.

If it is SB, you can sing at the top of your voice stand infront of a judge write letters to red stating that infact you owe the money BUT it will remain SB, nothing can in SB the debt. So even though you have paid something DO NOT pay anymore. As asked check your credit file to find out the info, anymore help please post and I am sure we can help.I all have learnt is from others on many sites.

I left the UK in Nov 2005 and entered UK in March 2010 for few weeks to gain entry clearance and left again for an year.
I moved completely in Jan 2011 and opened my Bank account, etc..
Everything seemed ok untill I applied for a Credit card and later a discount card at New Look.

What does your credit expert file say in relation to these debts? Do you have an CCJs? (county court judgements)
If you left in November 2005 presumably there was a period of 6years from Nove 05 to Nov 11 where you paid nothing towards these debts?
Stature Barred means that if there is a period of 6years where you do not pay anything towards the debt, and do not write to the creditor (or a debt collector) to acknowledge that you owe the money - and if they don't take you to court then the debt becomes legally statute barred. That means you don't have to pay and cannot be made to pay - but the debt would still legally exist.
Have a read of the factsheets linked to on this thread and check your credit file to see if you have any CCJs -Statute barred debts and the Limitation ActsA smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
I have opened my account with Credit Expert using my new address as I moved to another city within England. There is nothing on my profile which mentions anything about County Court Judgements.
I paid to 1st Credit in Sept-Oct 2011 when I applied for a Barclaycard. It was something silly that I did by applying for a credit card where I previously had debt.
After that I was shopping at New Look when they offered a discount card and did a credit check, which was pickedup by Red (lowell).0 -
If you paid in Oct/Nov 05 and then paid in Sept 11 then that debt won't be statute barred. Do you know what debt 1st credit are collecting?
Presumably red are collecting a different debt - and maybe that might be statute barred?
Anyway if anyone writes to you asking for money - first send the prove it letter to check what debt they are collecting and see that they have a right to collect it.

With regards to the red debt - try to work out if its statute barred.
If its not you say you don't want to pay the next direct debt payment - is the payment more than you can afford? If so you might need to write to them to offer a reduced repayment or to say you won;t pay anything until they have sent you proof of the debt.
If its a DD you can cancel it with your bank but watch out for red setting up it again.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0
