Council Tax Overpayments

Hi guys,

A few weeks ago there was the posting on here about the ruling that councils can't take overpayments from your benefits if you are BR.

This ruling applies to us in our favour!

How do we go about getting our council to action it? Do we need to call up and tell them? We've had no letters from our creditors about the bankruptcy (whether the OR has told them yet I'm not sure) but obviously I'm keen to get all the benefits we are due!

Also, can we get a back payment from the date the ruling came into effect, or is this just being cheeky?

    the date of the ruling should apply, but may not have filtered down to many staff yet.
    id ring your council and ask them if they have terminated the repayments, and to repay what has been taken since the hearing, if not why not, but be sure it is actual and the determination was final. It appears so from what ive read.
    You should go back to that original post and get the name of the case and mayb e someone can tell you the number of the circular it should appear in for HB CTB staff, wont have happened yet though.
    Councils get circulars for changes but something like this case hearing will know of it more or less straight away, certainely senior staff will have the knowledge.

    you dont get anything from anyone re your BR, your information is the paper you left with the date and BR reference on from the court you were declared BR on, everyone you will tell , will tap into a system and check and will know it has happened , certainely the council has that information.

    AFAIK, it should be backdated to the date of the court ruling.
