invalid proposal

After recently appealing online about our council banding, I have received a letter saying that council tax regulations prescribe 30 November 1993 as the last date for lodging proposals. This letter included a A4 page of "Council Tax (Scotland) Regulations on Time Limits for Proposals" with an A to H of stipulations.
I followed Martins directions for appealing so was quite bemused to receive this reply. Has anyone come across this problem before or give me some information on what to do next.

  • I too have applied for council tax rebanding - I was told by letter from the Listing Officer dated 31st Jan that my proposal was invalidly made and I should send further reasons if I wanted to appeal. I had recently obtained details of the sale in 1992 for £45,500 which put the cottage in Band B, not C as it is now. I have now received a letter dated 5th Feb from the Listing Officer saying that 'I am sending the papers relating to your appeal on this matter to the Clerk of the local Valuation Tribunal' and today I received a letter dated 7th again from the Listing Officer saying that he will 'pursue my review of your banding' but as it was out of the six months from becoming a taxpayer limit, 'I must ask you to withdraw your appeal...... and my case will be looked at on a local office report.........should be settled within the next two months.....' There is a 'council tax - notice of withdrawal of proposal/notice of consent to withdrawal of an appeal to the valuation tribunal' which I am to sign and return. I am well out of my depth here and don't know whether I should sign the form and rely on the council or let it go to the valuation tribunal. Any help would be much appreciated. At the bottom of the form it does say 'if an appeal to the valuation tribunal has been constituted, the listing officer will give notice to the clerk to the valuation tribunal when all parties have consented to the withdrawal of the appeal.' Who do I trust, the valuation tribunal or the council?
