Just in case anyone was wondering, I have his contract here with me and if I'm honest, it resembles Swiss cheese with the amount of holes in it.

Anyway, regarding holidays, it states 'In your employment role, you are entitled to 20 days holiday. These days are to include Bank Holidays if they fall on your scheduled working day or not'. It almost makes no sense! (Bold 20 is how it is written, so it seems that bit is for personalisation of the contract)

If he wants to go to an Employment Tribunal, the contract states that he must use a named solicitor, that solicitor is a trustee and so likely to either charge a fortune or fudge it up. Like I say, Swiss cheese springs to mind.

I don't think he wants to take it further, but I've advised he jots everything down in case they sack him for something stupid and quickly look for another job.

Ermm - your contract cannot tell you who to use for legal representation if you want to go to a Tribunal. That would be unlawful. And if I recall my trust law properly (which I may not, but I think I am correct) a trustee may not financially benefit from their position as a trustee. Which would make it doubly unlawful.

I assume the 20 days is for part-time work? Otherwsie that would also be unlawful.

It's 30 hours per week, spread over 5 days. The whole contract is just a bit rotten and looks as though someone with no experience wrote it, for example it also goes on about expenses and that only mileage will be paid over 100 miles, it's a one house care home, who is going to travel that amount?

I think it's best to leave this and I help him job hunt asap! But thank you for your advice throughout this thread. :T
