Help with letter from Marstons regarding baliffs

    You could also google CAG and post in bailiff forum when you have more info....alot of knowledgable people in terms of setting aside judgement and what to put down. They might know what a fine could have been for?

    It just gives the county we live in, which is a large city and the surrounding areas. It doesnt give an individual court or anything. We can try the city centre court first and work from there.

    I think we will just have to wait it out until Tuesday and ring the court and Marstons and see whats happened. I just cant believe its taken them 18months of sending letters elsewhere to get hold of him, when he has always been on the electoral roll and had a car registered and insured at this address for that whole time. So there must have been other letters sent somewhere. I personally think this will be relating to an old bill that him or his housemate have overlooked to close off. But they should have let them know before now.

    Thank you both for all the advise so far, its really helpful. Expect me back once we know what it is so I can find out how bad its going to look on our mortgage application. :(

    It's the word FINE that alludes me, if it was an old bill or council tax then it wouldn't say fine...

    Rule of thumb, do not let them gain access to your property under any circumstances, if you have a car keep this parked well away from your property, keep all doors and windows closed and locked.

    7.What is the difference between an enforcement agent and a High Court Officer?

    A certificated enforcement agent acts on the behalf of the magistrates' courts and local authorities and enforces distress warrants, warrants of execution and liability orders.

    A High Court Enforcement Officer is authorised by the Lord Chancellor to enforce Writs issued by the High Court.

    Looking at it it seems that you will need to take a trip down to the court personally on Tuesday. There you can have the judgement set aside on the basis that you received no paperwork or notice. This takes it back to the start so that you can defend the allegations.

    Sounds like it will be a small problem if you are unsure of which court it is. It may have to be a phone call to Marstons to ascertain what it is exactly

    Doesn't matter which court, find your local court and turn up there, Northampton is a bulk centre but that doesn't mean that if you get something from them you need to go to Northampton , I had a fine from Braintree courts and dealt with it at Colchester. Find your local court turn up there Tuesday morning and let them know that you have had a letter from bailiff in regards to a fine that you have no knowledge to and wish to apply for a set aside. I suppose if you really want you could inform marstons that you are applying for a set aside, but knowing bailiffs they are likely to then turn up so to increase their fees.... So I wouldn't inform them and I wouldn't call them. When and if you get the set aside then by all means write and call the bailiff and state that you have set aside against the fine.

    Say you owe me £1000, I live in Devon you live in Newcastle, I file small claims in Devon if you defend the case you can have it heard at your local court. If I come up to Newcastle and win my case I can also apply for costs ie travel etc but if you win your costs will be minimal so I will only be out of pocket 1k of what u owe me plus my costs as I am the instagotor of the proceedings. Hope that makes sense
