The National Minimum Wage (NMW) is currently set at £6.08. Can a fast food chain employ a 'delivery' driver at a lower rate per hour, say £4.50, by using the defence that that employee is self-employed and he will get on top of this flat-rate, for every food stuff delivered, £1.50?

If the driver is self employed then the minimum wage doesn't apply as they're not paying a wage.0

Of course
(a) You would have to be genuinely self-employed - which means that you must pass the test of HMRC as self-employed ( control of when and how you work, control of who does the work, etc - more information here http://www.hmrc.gov.uk/employment-status/index.htm
(b) Have to pay your own tax and NI as appropriate
(c) have to have appropriate insurance for your vehicle and, if you got anyone to cover your work for you at any time, potentially for your employee(s)!0 -
