Will they accept a returned 'Go Kart'?

I bought a (exclusive to ToysRus) 'Hello Kitty Go Kart' for my 5 year old for Xmas. I'm no good at making things like that up so my Father in law put it together and ditched the box it came in!
On xmas day my daughter loved it when she opened the wrapping paper but when she tried it out, she noticed the pedals do not stop turning round as it goes along! This means she can't take it down a hill to pick up speed and let her feet just stay still, like on a bike etc. On toysRus website it doesn't mension that the pedals continuosly turn! Can I return the go kart to them without the box it came in? I still have the receipt, the kart is in mint condition apart from very slight graze marks in the centre of the wheels which can't be avoided when using outside! Its been up and down my garden path about 5 times and its not that long. I'm fine with the idea of a credit note or paying more to get a kart at toysRus which (I've looked it up) has 'freewheel' (pedals can stop as kart moves). Do I have a chance of returning or would they get funny with me?

    They have no legal obligation to accept a return just because you changed your mind. So it comes down to the shops own terms and conditions. As it has had to be built I would doubt you would be able to return it buy you have nothing to lose but to ask.

  • I want to return it because its not suitable for my 5 year old daughter, nothing to do with me buying it & changing my mind later, as you put it. If it wasn't for the pedal problem she & myself would be happy as Larry! Like I said before,the actual Kart looks ace and its her fave brand! She likes to go as fast as she can but the kart restricts her and it becomes a little dangerous for her feet/legs getting caught up with the pedals keep turning!

    You can only return the kart it is faulty or not as described and its not faulty. The whole point of a fixed gear on the chain is a safety feature to stop the kart from freewheeling down hills, how fast do you want your 5 year old to go.

    Guessing it's this one which is for age 3+. Not sure why you would be happy with your 5 year old free wheeling downhills in that as it's clearly a young child's toy for just ambling up and down garden paths and around parks. To go freewheeling surely you would want something with more protection ?

    I think you have zero chance of a refund.

  • No, it's not faulty.

    The pedals will be linked to the rear (?) axle with a chain, and to have a ratchet mechanism between the pedals and this would be something over and above what the product needs to function. Possibly a feature, but as it was never advertised as having this it's irrelevant.

    This is a change of mind return, there is nothing wrong with the product. If you go in to store spouting off that it's not fit for purpose, they'll probably just laugh.

    Harsh, but the truth. In future, check the product has the features you want.

    it not meant for situations where the speed of the pedals are an issue
  • i wouldnt want my precious 5 yr old daughter to be free-wheeling "so" fast down a hill.... :o

    But you HAVE changed your mind - you thought it was what was suitable but after she's played with it you've decided it's not. It's not faulty or misdescribed, and in any case there's obvious marks where its been used and the packaging is missing so how would they be able to re sell it even if they did take it back, which they don't have to do because you want to return it after changing your mind.

    also most of these things are available to try on the shop floor
    so they do give parents the chance to have a look
