OPC tickets - reassurance please

I am writing on behalf of a friend. I have read the sticky, and it says to post a thread about your case if you still need advice or just reassurance even after reading the guide, so that is what I am doing.

My friend parked in a car park with a 'max 2 hours stay' sign up, for more than 2 hours on about 12 different days without realising. She is a student and was going to a part time minimum wage job nearby.

She has so far received 6 fines/invoices and counting from OPC. She reckons the total will come to about £600, which she cannot afford. She is absolutely terrified by the tickets. She went to Citizens Advice who told her to pay them before they double in 'cost'.

I have told her that she should not pay them, and if she wants to write to them to 'appeal', she needs to not use the word 'appeal' but just say 'stop harassing me you cowboys, you aren't getting a penny out of me, so save your stationery and postage costs for someone who might fall for it'. But I think she justs needs to hear this from the general population, not just from me.

I would appreciate if people with past experience could reassure her that ignoring everything will be the best course of action.

    Make sure your friend watches the Watchdog video.

    OPC have not done court for some time. Indeed the only time that they have found themselves inside a courtroom recently was as the defendant - Read Here.

    Ignore them from now on. That means ignore - totally. No letter of appeal will work as there is no real appeals mechanism that has any independance about it and there is a view that appeals are used as a means of obtaining maximum information including who, precisely, was driving at the time.

    Stressful as I know it is get her to ignore them and move on. The letters she is likely to encounter are also shown in the "stickies".
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Ignore them as advised, OPC have tried court in the past but must be tired of being spanked by now!
  • CAB need to be taken to task on providing misleading and downright stupid advice in relation to private parking scams. No doubt the advice was based on advice provided by the 'impartial' BPA.
    Still waiting for Parking Eye to send the court summons! Make my day!

    I think if OPC decided to take her all the way then she would end up paying much more.
    About 12times, she was just taking the p##s
    Your friend rolled the dice and got caught, now she will end up paying the price.

    OPC have lost every case we know about where they actually bothered to go to Court, where it was defended - except for the Thurlow case where it was initially badly defended by a nice old guy who then got pepipoo help and a proper decision on APPEAL from a higher Court:

    A very useful decision which people can now quote as a valid point in their own defence on the odd occasion some megalomaniac PPC office boy tries his hand at legal stuff. Although not a 'precedent' as such it's very compelling to a Small Claim judge and has been used already by others.

    Mostly double yellow line parking incidences.

    • Judge agreed that each amount was a penalty not a pre-estimate of damages
    Agreed that the Circuit Judge's findings in Thurlow v OB were persuasive
    • Nobody was obstructed, no spaces were taken and a permit was on display
    • Dismissed the notion that parking management was the purpose of the private ticketing regime'
